By accessing or using Ohana ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Description of Service
Ohana is a family memory preservation platform that allows you to upload photographs and attach voice recordings to create lasting memories for your family. The Service is designed to help families preserve and share their stories across generations.
User Accounts
To use Ohana, you must:
- Provide a valid email address for authentication
- Be at least 18 years old, or have parental consent if younger
- Keep your account credentials secure
- Notify us immediately of any unauthorized access to your account
You are responsible for all activity that occurs under your account.
Your Content
Ownership: You retain all rights to the photos, recordings, and other content you upload to Ohana. We do not claim any ownership over your content.
License: By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. This license ends when you delete your content or account.
Responsibility: You are responsible for ensuring you have the right to upload any content, including photos of other people. You agree not to upload content that infringes on others' rights.
Acceptable Use
You agree not to use Ohana to:
- Upload illegal content or content that violates others' rights
- Harass, abuse, or harm others
- Attempt to access other users' accounts or data
- Interfere with or disrupt the Service
- Use automated systems to access the Service without permission
- Upload malware or malicious code
We reserve the right to suspend or terminate accounts that violate these terms.
Family Sharing
Ohana allows you to invite family members to view and contribute to shared memories. When you invite someone:
- You are responsible for who you invite
- Invited members can view content you've shared with them
- You can revoke access at any time
Service Availability
We strive to maintain high availability, but we cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Intellectual Property
The Ohana name, logo, and all software, design elements, and documentation are our intellectual property. You may not copy, modify, or distribute these without permission.

Disclaimers
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free or uninterrupted.
While we implement strong security measures, we cannot guarantee absolute security. You acknowledge that you upload content at your own risk.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of the Service.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.
Changes to Terms
We may update these terms from time to time. If we make significant changes, we will notify you via email at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
Termination
You may terminate your account at any time by deleting it through the Service. We may terminate or suspend your account if you violate these terms, with notice when possible.
Upon termination, your right to use the Service ends, and your content will be deleted according to our Privacy Policy.
Governing Law
These terms are governed by the laws of the jurisdiction where our company is registered. Any disputes shall be resolved in the courts of that jurisdiction.
